Time to Confirm Everybody
Kentucky's greatest contribution to national life since Davy Crocket, Mitch McConnell, gave a talk to the Federalist Society today and seemed happy with the confirmation rate of Bush appointees. The problem is, of course, that the more originalist appointees face a phalanx of opposition from the Kennedys of this world. Boyle is a good man and as Ed Whelan has noted the opposition to him is substandard. There is a problem developing, that less rigourous defenders of the Constitituion sail through, but myrmidions of original intent face endless nitpicking from the Schumer Left and some Republicans give credence to this nonsense. There is a fact that must be kept in mind by every Senator: Conservative justices allow representative government as long as a clear Constitutional mandate does not prevent it. Democrat Judges oppose the people's will whenever it diverges from the preferences for the legal elite. We need judges who do not advance the interests of their class above what the Constitution either allows ro permits.
