Judges and the 2008 Elections

Tom Goldstein has an interesting article on scotusblog.com entitled Analysis: The Court and the 2008 Election. He concludes, "In sum, the 2008 election window presents the most significant opportunity to shape the direction of the Supreme Court that can be anticipated for roughly the next two decades - i.e., as far into the future as anyone can reasonably hope to look. For the left and the right, the stakes are genuinely high."

Presidential Candidate Gov. Romney recently spoke about his "kind of judge" at a dinner for the Massachusetts Citizens for Life. He stated,
"I think Chief Justice John Roberts put it best at his confirmation hearing. He described the role of a judge. He said, 'Judges and Justices are servants of the law, not the other way around. Judges are like umpires don't make the rules, they apply the rules... and I will remember that it's my job,' he said, 'to call balls and strikes and not to pitch or bat.'
"That's my kind of judge and that's the kind I'd appoint."
Presidential Candidate Sen. McCain also has further elucidated his opinion on selecting judicial nominees in a video on his campaign website. He states, "I will propose no litmus test on any judge. But it is very important to appoint justices such as Justice Roberts and Justice Alito who strictly interpret the Constitution of the United States."
