Ever since Joe Biden became President, the Left has pressured Supreme Court Justice Stephen Breyer to retire through a campaign spearheaded by "dark money" groups like Demand Justice:

After President Biden’s election, Demand Justice started bullying Justice Stephen Breyer into retirement. It ran aggressive ads and drove a mobile billboard around the Supreme Court that said: “Breyer, retire. It’s time for a Black woman Supreme Court justice. There’s no time to waste.”

Carrie Severino wrote today about liberals' attacks on the rule of law and Attorney General Bill Barr, all as part of their efforts to "resist" the presidency of Donald Trump:

What we have been witnessing is an all-out assault on the rule of law from the woke Left, which has elevated its political ideology to something resembling a secular religion. By this mentality, Trump and his agents are monomaniacally recast as totems of sinister forces who must be stopped at all costs. Judge Walker Confirmation Hearing Proves that Democrats Don't Understand the Role of Judges

Today was likely one of the last “controversial” hearings for a judicial nominee for President Trump’s first term.  Judge Justin Walker was before the committee as a nominee to the DC Circuit.  However, much of the Democrats' potential fire was taken away before the hearing even started.  Yesterday, the American Bar Association (ABA), the self-proclaimed "gold standard" of Senate Democrats, rated Judge Walker "Well Qualified."  Judge Walker had previously been rated "not qualified" by the ABA, due to his being just short of the required number of post-law school years of experience.

Yesterday, the Committee for Justice hosted a webinar on the Supreme Court and the 2020 election featuring RNLA Executive Director Michael Thielen, Curt Levey of the Committee for Justice, and Carrie Severino of the Judicial Crisis Network.  In his remarks, Mr. Thielen outlined presumptive Democratic presidential candidate Joe Biden's history regarding judges and judicial confirmations.  He described how then-Senate Judiciary Chairman Biden presided over both the character assassination of Robert Bork, creating the new term "borking," and the late, discredited attack on Clarence Thomas that created the playbook used against Brett Kavanaugh:

President Trump "Flips" Second and Eleventh Circuits

With the confirmation of Barbara Lagoa today, the number of judges appointed by Republican presidents versus Democratic presidents is now greater on three federal circuit courts than when President Trump took office.  Last week, the Second Circuit "flipped" from majority Democratic-appointed to majority Republican-appointed with the confirmation of Steve Menashi, and Judge Lagoa's confirmation today "flipped" the Eleventh Circuit.  As Ed Whelan wrote:

Demand Justice, a far left group run by former Hillary Clinton spokesman Brian Fallon that has become the left’s voice on judicial nominations, came out with their “short list” of potential liberal Supreme Court nominees.  The list is extreme to say the least.  How extreme?  As Carrie Severino points out:

The Left's War Against Judicial Independence

As we celebrate Constitution Day today, it is worth remembering that the Founders carefully wrote the Constitution to ensure that our third branch of government was independent through mechanisms such as life tenure, the prohibition against diminution of salary, and the nomination and confirmation mechanism itself, and that judicial independence is what preserves the Constitution and our system of government.  

Yet many liberals now want to undermine the independence of the judiciary because judges do not always reach the outcomes they desire to advance their progressive policy goals.  

Or perhaps more accurately, they are attempting to redefine judicial independence to mean a judiciary that advances progressive policy goals and interests.
