How Republicans Are Fighting the Left’s Efforts to Pack the Judiciary with Radical Ideologues

Posted on Blog by Republican National Lawyers Association (RNLA) · April 24, 2024 3:13 PM

Democrats are making every effort to pack the judiciary with radical ideologues. While Joe Biden hasn’t shaped the makeup of the Supreme Court as much as President Donald Trump did, according to the Daily Signal, “Biden is on track to match and possibly surpass his predecessor in successfully appointing lower court judges.” In addition, in recent years Democrats have poured millions into electing radical judges at the state level.

Democrats Manufacture Crisis to Provide Cover for Undermining the Supreme Court

Posted on Blog by Republican National Lawyers Association (RNLA) · July 18, 2023 10:06 AM

On Thursday, Senate Democrats led by conspiracy enthusiast Sheldon Whitehouse and Senate Judiciary Chairman Dick Durbin will take the next step in its quest to reshape the judiciary by holding a Committee vote on the Supreme Court Ethics, Recusal, and Transparency Act. Because the radical Left doesn't like some of the decisions made since Justices Gorsuch, Kavanaugh, and Barrett joined the Court, they have manufactured a crisis to provide cover for their attacks on the legitimacy of the Court. As Senate Republican Leader Mitch McConnell pointed out in remarks on the Senate floor last week:

The Supreme Court is not in crisis when it refuses to reliably and predictably advance Democrats’ priorities. The Court is not in crisis when it puts the text of our laws above politics.

Liberal Dark Money Bullied Breyer to Retire, Will it Also Choose His Replacement?

Posted on Blog by Republican National Lawyers Association (RNLA) · February 08, 2022 1:50 PM

Ever since Joe Biden became President, the Left has pressured Supreme Court Justice Stephen Breyer to retire through a campaign spearheaded by "dark money" groups like Demand Justice:

After President Biden’s election, Demand Justice started bullying Justice Stephen Breyer into retirement. It ran aggressive ads and drove a mobile billboard around the Supreme Court that said: “Breyer, retire. It’s time for a Black woman Supreme Court justice. There’s no time to waste.”

Liberals Attack Rule of Law and AG Barr

Posted on Blog by Lisa Dixon · May 15, 2020 8:30 PM

Carrie Severino wrote today about liberals' attacks on the rule of law and Attorney General Bill Barr, all as part of their efforts to "resist" the presidency of Donald Trump:

What we have been witnessing is an all-out assault on the rule of law from the woke Left, which has elevated its political ideology to something resembling a secular religion. By this mentality, Trump and his agents are monomaniacally recast as totems of sinister forces who must be stopped at all costs. Never mind notions of fair process and democratic deliberation that made the American system of law what it is.

Judge Walker Confirmation Hearing Proves that Democrats Don't Understand the Role of Judges

Posted on Blog by Michael Thielen · May 06, 2020 4:32 PM

Today was likely one of the last “controversial” hearings for a judicial nominee for President Trump’s first term.  Judge Justin Walker was before the committee as a nominee to the DC Circuit.  However, much of the Democrats' potential fire was taken away before the hearing even started.  Yesterday, the American Bar Association (ABA), the self-proclaimed "gold standard" of Senate Democrats, rated Judge Walker "Well Qualified."  Judge Walker had previously been rated "not qualified" by the ABA, due to his being just short of the required number of post-law school years of experience.

RNLA ED Michael Thielen: Biden's History on Judges Will Come Back to Haunt Him

Posted on Blog by Lisa Dixon · April 17, 2020 9:20 PM

Yesterday, the Committee for Justice hosted a webinar on the Supreme Court and the 2020 election featuring RNLA Executive Director Michael Thielen, Curt Levey of the Committee for Justice, and Carrie Severino of the Judicial Crisis Network.  In his remarks, Mr. Thielen outlined presumptive Democratic presidential candidate Joe Biden's history regarding judges and judicial confirmations.  He described how then-Senate Judiciary Chairman Biden presided over both the character assassination of Robert Bork, creating the new term "borking," and the late, discredited attack on Clarence Thomas that created the playbook used against Brett Kavanaugh:

President Trump "Flips" Second and Eleventh Circuits

Posted on Blog by Lisa Dixon · November 20, 2019 9:03 PM

With the confirmation of Barbara Lagoa today, the number of judges appointed by Republican presidents versus Democratic presidents is now greater on three federal circuit courts than when President Trump took office.  Last week, the Second Circuit "flipped" from majority Democratic-appointed to majority Republican-appointed with the confirmation of Steve Menashi, and Judge Lagoa's confirmation today "flipped" the Eleventh Circuit.  As Ed Whelan wrote:

165 Trump Judges Confirmed

Posted on Blog by Lisa Dixon · November 19, 2019 9:02 PM

With the confirmation of Robert Luck to the Eleventh Circuit today, 165 of President Trump's superb judicial nominees have been confirmed by the Senate.  These judges who support and respect the rule of law and interpret the text of the Constitution as written are changing the federal courts.  As Carrie Severino writes:

Liberal Judge List Too Extreme for . . . Obama?!?

Posted on Blog by Michael Thielen · October 15, 2019 7:56 PM

Demand Justice, a far left group run by former Hillary Clinton spokesman Brian Fallon that has become the left’s voice on judicial nominations, came out with their “short list” of potential liberal Supreme Court nominees.  The list is extreme to say the least.  How extreme?  As Carrie Severino points out:

Amazing: there must be hundreds of federal judges Obama put on the courts, and only 4 make this list. This list would have been way too liberal for Obama.

The Left's War Against Judicial Independence

Posted on Blog by Lisa Dixon · September 17, 2019 6:50 PM

As we celebrate Constitution Day today, it is worth remembering that the Founders carefully wrote the Constitution to ensure that our third branch of government was independent through mechanisms such as life tenure, the prohibition against diminution of salary, and the nomination and confirmation mechanism itself, and that judicial independence is what preserves the Constitution and our system of government.

Yet many liberals now want to undermine the independence of the judiciary because judges do not always reach the outcomes they desire to advance their progressive policy goals.

Or perhaps more accurately, they are attempting to redefine judicial independence to mean a judiciary that advances progressive policy goals and interests.
