The Many Problems of "Dark Money" Marc Elias

Leftist "dark money" lawyer Marc Elias' problems are piling up. As The Washington Free Beacon reported, a federal judge reprimanded Elias last week for bringing a frivolous suit defending New York's redistricting maps:

It's not every day that a federal judge calls a lawsuit from one of the country's top lawyers a nasty and partisan "Hail Mary pass" intended to undermine free and fair elections. But that's what happened on Wednesday when U.S. District Judge Lewis Kaplan, a Clinton appointee, tossed out a lawsuit brought by Democratic superlawyer Marc Elias.

The Left's Worst Takes on the SCOTUS Leak

As soon as POLITICO published a leaked draft opinion written by Supreme Court Justice Samuel Alito that would overturn Roe v. Wade and its progeny, the hot takes from the Left rolled in. Demand Justice Executive Director Brian Fallon's reaction exemplified where a lot of the Left is at. They are praising the leaker as a hero, rather than acknowledging the disastrous implications the leak has for the Court.

Is a brave clerk taking this unpredecented step of leaking a draft opinion to warn the country what's coming in a last-ditch Hail Mary attempt to see if the public response might cause the Court to reconsider?

The Left's Assault on the Supreme Court Continues

On Tuesday, the Senate Judiciary Subcommittee on Federal Courts, Oversight, Agency Action, and Federal Rights held a hearing titled "An Ethical Judiciary: Transparency and Accountability for 21st Century Courts" to promote anything but ethics and transparency in the judiciary. The hearing was another effort to promote legislation that would impose unworkable recusal standards on the Supreme Court Justices and chill the speech of amici who want to make their voice heard on the most important legal issues of the day.

In Contrast to Democrats, GOP Signals Respectful Questioning for KBJ Hearing

On Monday, the Senate Judiciary Committee wrapped up the first day of Supreme Court confirmation hearings for Judge Ketanji Brown Jackson. From the start of the hearing, it became clear that the atmosphere of the hearings would be night and day from the hearings for former President Trump's nominees to the Court (Justices Amy Coney Barrett, Brett Kavanaugh, and Neil Gorsuch). Ranking Member Chuck Grassley explained during his opening statement:

We will conduct a thorough, exhaustive examination of Judge Jackson’s record and views. We won’t try to turn this into a spectacle based on alleged process fouls. On that front, we’re off to a good start. Unlike the start to the Kavanaugh hearings, we didn’t have repeated, choreographed interruptions of Chairman Durbin during his opening statement like Democrats interrupted me for more than an hour during my opening statement at the Kavanaugh hearing.

Politically-Charged KBJ Opinion Boosted "Dark Money" Support

Since the nomination of Judge Ketanji Brown Jackson to replace Justice Stephen Breyer on the Supreme Court, we've heard about the extensive support she has received from leftist "dark money" groups like Demand Justice. But where did this support originate? Earlier today, Republican Leader Mitch McConnell explained how a "politically charged" opinion she issued while serving as a District Court judge seems to have boosted her profile with the "dark money" Left:

“Before the 2020 election, one far-left dark-money group put Judge Jackson on their Supreme Court shortlist.

“Well, not at first. She was left off their first version. But shortly thereafter, the Judge published a fiery 118-page opinion in a politically-charged case that won attention and praise from liberal pundits.

SCOTUS: Biden's Missed Opportunity to Bring the Country Together

During his campaign, President Biden assured the American people that he would do whatever he could to unite the country. In today's uncertain times, that promise is even more poignant. Biden missed a major opportunity to bring the country together when he made his pick to replace Justice Stephen Breyer on the Supreme Court. As Republican Senator Lindsey Graham explained, President Biden had the option to replace Justice Breyer with someone from his own shortlist who had the potential to receive true bipartisan support, District Court Judge Michelle Childs:

“Here’s the point: I was willing to get probably double-digit Republican support for somebody that would have been in the liberal camp from my state,” he added, referring to Childs. “So they made a political decision to reject bipartisanship and go another way.”

Leftist Group Targets Republican Election Lawyers

On Monday, Axios reported that a leftist dark money group is looking to target Republican lawyers that were involved in litigation surrounding the 2020 election:

A dark money group with ties to Democratic Party heavyweights will spend millions this year to expose and try to disbar more than 100 lawyers who worked on Donald Trump’s post-election lawsuits, people involved with the effort tell Axios. . .

A new report from the Washington Examiner reveals that more problems are on the horizon for "dark money" Marc Elias whose firm is representing Black Lives Matter in a fraught tax filing:

The national organization for Black Lives Matter appears to have used an unusual accounting maneuver to further delay reporting what became of its $60 million bankroll from 2020, a move one charity watchdog called "the worst transparency issue" she has ever seen.

After President Biden’s election, Demand Justice started bullying Justice Stephen Breyer into retirement. It ran aggressive ads and drove a mobile billboard around the Supreme Court that said: “Breyer, retire. It’s time for a Black woman Supreme Court justice. There’s no time to waste.”

Hearing Exposes Extreme Partisanship of Judicial Nominee

On Wednesday, the Senate Judiciary Committee held a confirmation hearing for a number of judicial nominees. Among them was Dale Ho, nominated to be United States District Judge for the Southern District of New York. Throughout the hearing, Republican Senators expressed concern over Ho's prior partisan rhetoric, especially on social media.
