ICYMI: Sen. Mike Lee Demands Apology from Rick Hasen for Untruthful Statements

On Wednesday, Senator Mike Lee accused liberal law professor Rick Hasen of testifying untruthfully before the U.S. Senate Judiciary Committee's Subcommittee on The Constitution and demanded that he apologize. In his testimony, Hasen made personal attacks on the integrity of Chief Justice John Roberts and Justice Samuel Alito, asserting that they intentionally misconstrued the Voting Rights Act in Brnovich for the ulterior objective of making it difficult for citizens to obtain legal protection for their right to vote.

The Dangerous Radical Positions of Biden's DOJ Nominees

Biden Administration Attorney General Nominee Merrick Garland has pledged not to follow in the footsteps of the Obama-Biden Administration Attorneys General and act as a “wingman” for the President.  He will almost certainly be confirmed with bipartisan support.

However, the same cannot be said about Associate Attorney General Nominee Vanita Gupta and Civil Rights Division nominee Kristin Clarke.  Arguably, Judge Garland’s toughest moment in the hearing yesterday came when “Garland appeared to lose his composure as he defended Gupta and Clarke.”

Big Tech Censorship Highlighted by Republican Senators at Commerce Hearing

This morning, the CEOs of Facebook, Google, and Twitter testified before the Senate Committee on Commerce, Science, and Transportation. The Republican senators in the hearing highlighted the big technology companies' censorship of conservative speech, particularly the recent actions of Twitter and Facebook to suppress the story regarding Hunter Biden's international exploits. All three will return (virtually) to the Senate on November 17 for a hearing before the Senate Judiciary Committee.

ABA Smears Van Dyke With Apocryphal Evaluation

The American Bar Association has shown bias so extreme that some of its leaders are leaving or complaining of their evaluation of Ninth Circuit nominee Lawrence VanDyke.  While some of their not-qualified rating is at best subjective and biased, some of it seems to be based on an outright subversion of what he said:

The ABA letter falsely claims that Lawrence VanDyke "would not say affirmatively that he would be fair to any litigant before him, notably members of the LGBTQ community." In fact, he flatly told the secret ABA evaluator (Marcia Davenport) that he would be fair to all litigants.

Trump Nominee Attacked for Defending Israel and Attorney-Client Privilege

President Trump nominated Steven Menashi to the Second Circuit. In a fair world, Mr. Menashi would breeze through the hearings. The liberal gold standard of Senate Minority Leader Chuck Schumer, the American Bar Association, rated him “well qualified.” His personal background is also inspiring. Menashi’s paternal grandparents were Iraqi Jews, living in Baghdad, before moving to Tehran and then finding a home in Israel. His grandmother survived the Farhud, a violent pogrom against the Jewish community of Baghdad in 1941, by fleeing the city for the countryside. Menashi’s grandfather fled Ukraine for the United States at age 16 and his maternal grandmother’s family emigrated from Lithuania.

Rao Hearing Shows How Democrats Only Care About Liberal Women

The Senate Judiciary Committee confirmation hearing for Neomi Rao on Tuesday showed yet again that though Democrats claim to be the party that champions women and minorities, they really only care about championing those who agree with their increasingly radical policy views.  Instead of celebrating the impressive career and achievements of a minority woman, the daughter of immigrants, the Senate Judiciary Democrats attacked her and tried to mischaracterize her views.  As Ashley Baker explained in Fox News today, Rao is a threat to the Democrats precisely because she is a minority woman who does not have progressive views:

Senate Judiciary Advances AG Nominee Barr and 44 Judicial Nominees

Today, at the end of a long executive business meeting, the Senate Judiciary Committee voted to report favorably the nominations of William Barr to be Attorney General and 44 judicial nominees, including circuit court nominees Bridget S. Bade (Ninth Circuit), Paul B. Matey (Third Circuit), Eric D. Miller (Ninth Circuit), Eric E. Murphy (Sixth Circuit), Chad A. Readler (Sixth Circuit), and Allison Jones Rushing (Fourth Circuit).  The judicial nominees had previously had hearings in the Senate Judiciary Committee but were held up by Democrats' delays and obstructions, so they had to be re-nominated by President Trump in this Congress.
