The Many Problems of "Dark Money" Marc Elias

Leftist "dark money" lawyer Marc Elias' problems are piling up. As The Washington Free Beacon reported, a federal judge reprimanded Elias last week for bringing a frivolous suit defending New York's redistricting maps:

It's not every day that a federal judge calls a lawsuit from one of the country's top lawyers a nasty and partisan "Hail Mary pass" intended to undermine free and fair elections. But that's what happened on Wednesday when U.S. District Judge Lewis Kaplan, a Clinton appointee, tossed out a lawsuit brought by Democratic superlawyer Marc Elias.

Liberal Rick Hasen Says Americans May Have to Take to Streets in 2024

On Thursday, election law professor Rick Hasen appeared on MSNBC's "All In With Chris Hayes" to discuss the risk of election subversion during upcoming elections. Despite the segment being entitled "Republicans Against Democracy," Hasen, a liberal, began the process to undermine democracy in the 2024 election should Republicans win even before the candidates are known:

"It may take the American people going out into the streets to assure that we can have a free and fair election in 2024."

We'll give Professor Hasen the benefit of the doubt that he did not mean "take to the streets" in the way that a Black Lives Matter leader recently used it to stand for rioting and burning. However, it lines up with the alarming trend of Democrat activists not accepting election results. As Professor Derreck Mueller noted, the last time all the Democrats in Congress accepted a Republican Presidential election victory was in 1988.

Democrats and Elias Lost Election Law Cases “7 to 1” in 2020 Before Election Day

If you only read Democracy Docket or follow Marc Elias on Twitter, you might think that the left has never lost an election case ever. However, liberal election law professor Rick Hasen pointed out on Friday that this is simply not true:

The pre-election story is not documented quite as well, but it should be, as the outcomes were instructive. On the left, party committees, Super PACs, advocacy organizations and, to a lesser extent, civil rights groups brought dozens of suits challenging state election laws, regulations, or practices – particularly, though not exclusively, as they related to voting during the pandemic.  Overall, the litigation was unsuccessful, with losses outnumbering even partial wins by a ratio of more than 7:1.

Even the Left is Tired of Marc Elias

In a recent Election Law Blog post, liberal Professor Rick Hasen said what everyone is thinking, but no one wants to admit. Even those on the left are getting tired of Democrat election lawyer Marc Elias (of Steele dossier infamy):

Marc is a controversial figure in the election law world, and he’s become something of an online bully, castigating those who disagree with him even on issues of strategy and tactics who might be natural allies. And once Marc attacks, he has 600,000 Twitter followers who follow suit and believe (thanks in part to some of Marc’s own posts and media appearances) that Marc is singlehandedly fighting against attempts to suppress votes and subvert election outcomes. (In fact, much of this work is done by voting rights lawyers, many without any affiliation with the Democratic Party.) I get lots of messages from election lawyers and professors complaining about Marc but reluctant to voice their criticisms publicly. . .
