Over a month after Election Day, the NY-22 congressional race has yet to be decided. In fact, it is the only remaining House race to be called. Republican Claudia Tenney is currently 12 votes ahead and has urged the certification of the results. However, NY Supreme Court Justice Scott J. DelConte has ordered election officials from 8 counties to recanvass ballots — including some that were previously mishandled by local officials. This is problematic because it sets a precedent for allowing votes to be counted after the statuary period to do so has expired.

Last week, a 4th Circuit panel reversed a District Court decision that struck down North Carolina's voter ID law. The law requires voters to present a valid photo ID to vote in-person or by absentee ballot. As reported by the Washington Post:

What's going on in Nevada? Despite Clark County Registrar Joe Gloria's recommendation to hold a special election for the District County Commissioner race after a narrow 10-vote victory by Democrat Ross Miller, the County Commission has instead voted to certify the results. County Registrar Gloria reasoned that the outcome of the race could not be certain until "unexplained discrepancies" were remedied. The only way to do this? Hold a special election.

On Tuesday, Senator Ted Cruz released a statement asking the U.S. Supreme Court to hear an emergency motion filed by two Republican congressional candidates challenging the election results certified by Pennsylvania.

In a year when Democrats insisted that a "blue wave" was coming, not a single Republican House member lost their bid for reelection in 2020. Even better, Republicans flipped 4 seats in the liberal stronghold of California.

In a victory for religious liberty, the United States Supreme Court granted an injunction last Wednesday, protecting two New York religious organizations from New York Governor Andrew Cuomo's executive order that imposed "very severe restrictions on attendance at religious services in areas classified as 'red' or 'orange' zones" pending a decision on the merits of the case by the Second Circuit.

The Court's unsigned per curiam opinion was joined by Justices Thomas, Alito, Gorsuch, Kavanaugh, and Barrett. Both Justices Gorsuch and Kavanaugh wrote concurring opinions. Chief Justice John Roberts wrote a dissenting opinion. Justice Breyer also authored a dissenting opinion that Justices Sotomayor and Kagan joined. Justice Sotomayor wrote her own dissenting opinion joined by Justice Kagan.

On Wednesday afternoon, President Donald Trump announced that he has pardoned General Michael Flynn. The pardon ends the drawn-out battle between the Department of Justice and District Court Judge Emmet G. Sullivan who refused to dismiss the charges against General Flynn after new evidence was discovered that led to the Department's recommendation to drop the charges.

On November 18th, the Senate Rules Committee met to consider the nominations of Shana M. Broussard, Sean J. Cooksey, and Allen Dickerson to the Federal Election Commission. Confirming the nominees is especially important, since the FEC lost a shortly-held quorum earlier this year when Commissioner Caroline Hunter resigned. 

Judicial confirmations are continuing full speed ahead thanks to the leadership of Senate Majority Leader Mitch McConnell and Senate Judiciary Chairman Lindsey Graham. As reported by Carrie Severino for the National Review:

The Senate has recessed for Thanksgiving break, but not before processing a number of judicial nominees. Five new trial judges were confirmed last week, four to various district courts and one to the Court of International Trade.
