Earlier this week, the U.S. Supreme Court stayed a lower court's ruling to keep the pandemic-era Title 42 immigration policy in place which many see as the only thing stopping the crisis out our southern border from becoming even more out of control than it already is. National Review reported:
In a filing, Chief Justice Roberts stayed the lower court order that ended the pandemic-era policy, which had allowed the administration to expel illegal immigrants as a means to prevent the spread of communicable diseases. Roberts gave the DOJ until Tuesday at 5:00 p.m. to file a response to the states petitioning to maintain Title 42.
The order comes after Arizona filed an emergency appeal Monday asking the Supreme Court to preserve Title 42 before its expiration date on Wednesday.
Written by Arizona attorney general Mark Brnovich, the request was directed to Roberts to review on behalf of applicants Arizona, Louisiana, Missouri, Alabama, Alaska, Kansas, Kentucky, Mississippi, Montana, Nebraska, Ohio, Oklahoma, South Carolina, Texas, Tennessee, Utah, Virginia, West Virginia, and Wyoming.
“No one reasonably disputes that the failure to grant a stay will cause a crisis of unprecedented proportions at the border. DHS estimates that daily illegal crossings may more than double from around 7,000/day to 15,000/day once Title 42 is terminated,” the filing read.
Republican and even some Democrat Members of Congress are in favor of keeping the policy in place:
"There is a security and humanitarian nightmare at our border, and ending Title 42 right now will only make it worse," said Arizona Sen. Kyrsten Sinema, the former Democrat who switched her party affiliation to Independent earlier this month. . .
Montana Sen. Jon Tester, considered one of the most vulnerable Democratic Senators up for re-election in 2024, supported an extension of the Trump-era policy, a spokesperson for the senator's office told Fox. . .
Rep. Tony Gonzales, R-Texas, who represents a large portion of the Texas border with Mexico, said the public health order is one of the few effective tools law enforcement uses.
"While Title 42 was never intended as a permanent solution, it is the last line of defense for law enforcement along the border. Without it, we can expect illegal crossings to double overnight," Gonzales told Fox News.
Meanwhile, the Biden Administration continues to double down on its extremist border policies and deny the existence of the crisis it created.

The new Republican House majority must hold the Biden Administration accountable for the crisis at our southern border.
