Today, Justice Brett Kavanaugh’s replacement on the D.C. Circuit, Neomi Rao, was confirmed. This was yet another “victory” in the effort to confirm great judges and justices. The results are starting to show.
- With the confirmation of Judge Paul Matey yesterday President Trump “flipped’ the Third Circuit, which now has a majority of Republican appointments.
- The confirmation of Neomi Rao marked the 36th circuit judge that President Trump has appointed. President Trump has appointed roughly one-fifth of all circuit judges, with more to come.
- Last year, President Trump broke the record for the most circuit court of appeals judges confirmed in the first two years of a presidency and with the help of Senate Majority Leader Mitch McConnell and Judiciary Chairman Lindsey Graham, there are no signs of slowing down.
Meanwhile, Senate Democrats are in disarray. Don’t take our word for it. Just listen to the Ranking Democrat on Senate Judiciary, Dianne Feinstein today (at 7:50):
I am really very concerned, by the fact, no other members—on our side here. These are circuit court nominees. They are controversial. And, it seems to me that we ought to have a full presence on our side [Senate Democrats]. That’s not your problem [Chairman Graham]—it’s my problem. But, I do want to say that.
President Trump and Republican Senators are appointing and confirming to the bench high quality circuit nominees and Democrat Senators aren’t even showing up at the meeting. Feinstein does have a problem but she is wrong about one thing, these nominees should not be controversial. As President Trump has said he is appointing judges that: “interpret the Constitution as written. Judges are not supposed to re-write the law, re-invent the Constitution, or substitute their own opinions for the will of the people expressed through their laws.” With judges like that, all Americans are winning.
